- INTRODUCTORY PROVISIONS
- These General Terms and Conditions of Business and Carriage govern the conditions for the carriage of passengers on sightseeing boats operated by Jihočeská plavební společnost s.r.o. (hereinafter referred to as “JPP”), ID: 05656702, with registered office at Ve Žlíbku 2483/73, Horní Počernice, 19300. These conditions apply to scheduled cruises, sightseeing cruises, private cruises, and all services provided by JPP.
- CONCLUSION OF CONTRACT
- The contractual relationship between the customer and JPP is established by purchasing a ticket, confirming an online reservation, or confirming a cruise order sent via email by JPP. By purchasing a ticket or confirming an order, the customer agrees to these terms and conditions.
- RIGHTS AND OBLIGATIONS OF PASSENGERS
- Passengers are obliged to follow the instructions of the crew, behave considerately, and not endanger the safety of others. Prohibited actions include, for example, jumping from the deck, unauthorized entry into technical areas, or noisy behavior. Violations may lead to exclusion from carriage.
- CARRIAGE OF PERSONS AND LUGGAGE
- JPP carries persons with a valid ticket. Persons with reduced mobility are entitled to assistance. Luggage, strollers, and bicycles are carried according to operational capacity. Dangerous items are not permitted.
- CARRIAGE OF ANIMALS
- Dogs must be on a leash and wearing a muzzle at all times during carriage, or be carried in a closed transport box. Other animals may only be carried with the captain’s consent, provided they do not endanger the safety or comfort of other passengers.
- CANCELLATION POLICY
- Group reservations (10 or more people):
- No cancellation fee if cancelled at least 21 days before the cruise date.
- 20% of the total price if cancelled 7–20 days in advance.
- 50% of the total price if cancelled 48 hours to 6 days in advance.
- 80% of the total price if cancelled 24–48 hours in advance.
- 100% of the total price if cancelled less than 24 hours in advance or in case of a no-show.
- In the event of a change in the number of passengers up to ±10%, no fee is charged. For larger deviations, the cancellation policy for no-show passengers applies.
- Group reservations (10 or more people):
- LIABILITY AND EXCLUSION OF CLAIMS
- JPP is not liable for delays or cruise cancellations due to force majeure, technical faults, or adverse weather. No right to compensation arises.
- PERSONAL DATA PROTECTION
- JPP processes personal data in accordance with GDPR and the Personal Data Protection Act. Details are available on the company’s website.
- FINAL PROVISIONS
- The binding version of these terms and all related documents is in the Czech language. These terms are governed by the laws of the Czech Republic. The competent court for dispute resolution is the court at the company’s registered office. Effective from the date of publication.
- CARRIAGE OF BICYCLES, STROLLERS, AND SPORTS EQUIPMENT
- The carriage of bicycles, baby strollers, bicycle trailers, and sports equipment is possible according to the current capacity of the vessel and operational conditions. Electric bicycles cannot be charged during the cruise.
- JPP considers electric bicycles and scooters as high-risk carriage. Passengers are obliged to keep electric bicycles and scooters under supervision and, if possible, remove the battery from the device.
- Group bicycle transport must be reported in advance and confirmed by JPP.
- COPYRIGHT AND PHOTOGRAPHS
- JPP is entitled to take photographs, video, and audio recordings from publicly accessible cruises for marketing and promotional purposes (e.g., on the website, social networks, leaflets, etc.). Customers are not entitled to remuneration for the use of these recordings nor to their deletion if it is a standard public recording of the event.
CONTRACTUAL TERMS AND CONDITIONS OF CARRIAGE FOR PASSENGER WATER TRANSPORT

- SCOPE OF VALIDITY
- These Conditions apply to all vessels operated by JPP, including their premises and landing stages, and govern the legal relationships between customers and JPP. The provisions apply to scheduled transport, occasional transport, charter trips, sightseeing cruises, and all other services provided by JPP.
- BASIC OBLIGATIONS OF PASSENGERS
- Persons entering port facilities or vessels operated by JPP are obliged to comply with the provisions and rules of these Conditions when boarding the vessel, throughout their stay on the vessel, and when disembarking from the vessel; by entering vessels operated by JPP (hereinafter referred to as “Vessels” or “Vessel”), passengers express their consent to these Conditions.
- Passengers may only use designated entrances and exits, landing stages, piers, access points, and stairs when boarding and disembarking.
- Passengers may board or disembark from the Vessel only when the captain of the Vessel or JPP staff grants permission to board or disembark.
- Passengers and other users of the piers must behave in a way that does not endanger the safety of water transport and order on board.
- Passengers and other persons on board must follow the instructions of the Vessel’s captain, their representative, or other members of the ship’s crew (JPP staff) given in the interest of the safety of persons and navigation, and maintain order on board and on landing stages, piers, access points, and stairs. Persons suspected of endangering the operation of the Vessel (e.g., visibly intoxicated persons, persons under the influence of narcotic and psychotropic substances, etc.) or harassing other passengers may be excluded from carriage.
- PASSENGER BEHAVIOR
- When using Vessels and facilities operated by JPP, passengers must behave in a way that ensures the safety and order of operation and their own safety, while simultaneously being obliged to show consideration for other persons (especially other passengers and Vessel crews) and the rights of these other persons.
- On the Vessels, passengers are strictly prohibited from:
- jumping from the deck;
- standing on chairs, tables, and benches or climbing on the vessel’s railings, sitting or standing on the railings;
- opening closed entrance doors or barriers;
- entering the engine room, technical areas, or the wheelhouse without being accompanied by JPP staff (crew members);
- blocking entrances, exits, and emergency exits;
- throwing any objects from the Vessels or allowing any objects to protrude from the vessels;
- making noise on the deck of the Vessel, playing music without the consent of the vessel’s captain, or playing audio equipment or radio equipment, mobile phones, Bluetooth speakers, etc.;
- staying permanently only in corridors and at exits (escape routes);
- urinating from the deck;
- smoking on the vessel outside designated areas;
- using entertainment pyrotechnics;
In the event of a violation of any prohibition listed above under points a. to k. of this paragraph, JPP may apply a contractual penalty (sanction) for each such individual violation of the prohibition listed above under points a. to k. of this paragraph in the amount of 1,000 CZK, which is payable within 30 days from the date of the violation of any prohibition listed above under points a. to k. of this paragraph. Payment of the contractual penalty according to the previous sentence does not affect JPP’s right to compensation for damages.
- Passengers may activate signal devices on the Vessels only in case of emergency or in a dangerous situation. In the event of activation of signal devices on the Vessels for reasons other than those stated in the previous sentence, i.e., in the case of misuse of the signal device on the Vessels, JPP may apply a contractual penalty (sanction) for misuse of the signal device on the Vessels in the amount of 5,000 CZK, which is payable within 30 days from the date of misuse of the signal device on the Vessels. Payment of the contractual penalty according to the previous sentence does not affect JPP’s right to compensation for damages (consisting, for example, in the reimbursement of costs incurred in connection with the activities of the integrated rescue system, etc.).
- Passengers may only use designated entrances and exits, landing stages, piers, access points, and stairs for boarding and disembarking. Passengers may board or disembark only when JPP staff grants permission.
- In the case of a group trip, the guide or the organizer of an occasional trip is responsible for their fellow passengers and must ensure that their group complies with the provisions of these Conditions.
- Passengers who soil or damage JPP’s facilities, means of transport, or equipment are obliged to pay the fixed or actual costs of cleaning or repair determined by JPP.
- Goods may be sold, and advertising or promotion of goods may be carried out on all JPP facilities only with the prior consent of JPP.
- It is forbidden to stay on the deck of the Vessels in inappropriate clothing, especially, but not exclusively, in swimwear only, in underwear only, without clothing on the upper part of the body, etc.
- The use of unmanned aerial vehicles (e.g., drones) or other remote-controlled devices or models on board the Vessels is prohibited.
- Consumption of brought-in drinks and food on board the Vessels is not permitted.
- CARRIAGE
- JPP has no obligation to carry.
- JPP carries all passengers based on these Conditions.
- Passengers on board must follow the instructions of JPP staff and follow the instructions posted on the Vessel.
- The carriage of groups must always be reported to JPP in advance.
- PERSONS WITH DISABILITIES
- Carriage of persons with disabilities may be refused if it is in conflict with applicable safety regulations or if such carriage is not possible for technical reasons.
- JPP will provide maximum support to the persons mentioned in Art. V. para. (1) of these Conditions, but the person concerned must inform the Vessel’s staff of the required assistance in a timely manner.
- Persons with reduced mobility have the right to free assistance at the pier (when going to the boat, during boarding and disembarking, and when finding a seat).
- JPP will be guided by the needs of the person with a disability, including persons with reduced mobility, when assigning seats; if such a person is accompanied by a third party, this person (companion) will be assigned an adjacent seat if possible.
- PERSONS EXCLUDED FROM CARRIAGE
- Persons (passengers) without a valid ticket or other authorization issued by JPP are excluded from carriage.
- JPP may exclude from carriage persons who do not comply with order or the instructions of JPP staff, or who disturb other passengers by their condition or behavior. In this case, no claims for a refund of the fare already paid arise.
- Children under twelve (12) years of age may only be carried when accompanied by a person over eighteen (18) years of age, or another suitable companion, whose suitability shall be decided by JPP staff. Persons accompanying persons under twelve (12) years of age are obliged to supervise the behavior of these persons and, among other things, must ensure that they comply with the provisions of these Conditions.
- JPP does not carry persons with communicable diseases. Persons who fall ill during the trip will be carried to the nearest port where medical assistance can be provided to them.
- Persons who would obviously harass passengers on board due to drunkenness or inappropriate behavior will not be carried or will be carried only to the nearest port.
- Furthermore, persons with firearms are excluded from carriage, with the exception of members of security forces and the armed forces.
- TICKETS AND TICKET PRICES
- Tickets can be purchased at relevant sales points on land, online, or directly on the Vessel.
- Pre-purchased tickets must be presented to JPP staff upon boarding and disembarking from the Vessel, even without being asked.
- If pre-sale is not possible, the passenger must purchase a ticket immediately after boarding the Vessel, even without being asked.
- The passenger must have a valid ticket with them during carriage on the Vessel.
- Current fare prices are published online at www.jihoceskaplavebni.cz or at www.plavbyhracholusky.cz and at the piers and ticket offices via a notice board. Passengers must immediately verify the consistency of the fare price stated in the price lists with the amount paid by the passenger and, in case of any discrepancies or errors, complain at the relevant sales point. Later complaints (objections) will not be considered.
- The purchase of a ticket does not entitle the holder to a specific seat (seat reservation).
- A customer who is caught without a valid ticket (valid travel document) is obliged to pay JPP the fare and also a contractual penalty (sanction) in the amount of 1,000 CZK for violating the obligation to have a valid ticket with them during carriage on the Vessel, which is payable within 30 days from the date of the violation of this obligation. Payment of the contractual penalty according to the previous sentence does not affect JPP’s right to compensation for damages.
- A customer who is caught without a valid ticket (valid travel document) is obliged to pay JPP the fare and also a contractual penalty (sanction) in the amount of 1,000 CZK for violating the obligation to have a valid ticket with them during carriage on the Vessel, which is payable within 30 days from the date of the violation of this obligation. Payment of the contractual penalty according to the previous sentence does not affect JPP’s right to compensation for damages.

- EXCLUSION OF CLAIMS
- Deviations from timetables due to force majeure, adverse weather conditions (strong wind, storms, even if they were forecast), low or high water levels, traffic obstacles, operational failures or interruptions, and lack of space on the Vessel do not establish a right for passengers to compensation for any damage (harm).
- JPP is not obliged to wait for delayed arrivals of other public or private means of transport and is not liable for any failure of a reserved trip due to passenger delays. JPP is not liable for any operational delays, for whatever reason, and does not provide any compensation or guarantee for connections to other public or private means of transport.
- INTERRUPTION OF CRUISE
- JPP does not carry passengers if transport is made impossible by unavoidable circumstances or extraordinary events.
- In the event of accidents, provision of assistance, measures by state administration and local government authorities, or other similar circumstances, the route may be changed or the Vessel’s trips shortened; in such cases, it is not possible to request a refund of the fare from JPP or to assert any other claims.
- JPP may temporarily suspend the carriage of passengers on Vessels in the event of special commercial, operational, or local conditions.
- If the minimum number of participants for a sightseeing or promotional trip on the Vessels is insufficient, the trip may be cancelled. The decision to cancel a sightseeing or promotional trip on the Vessels shall be made by JPP staff. In the case according to the previous sentence, passengers may be provided with alternative services; otherwise, payments for the fare and any other services paid for by the passengers will be refunded if these were not used by the passengers.
- If the reason for excluding a passenger from carriage is discovered or if it occurs only after the start of the trip, the passenger is obliged to leave the Vessel immediately at the next stop upon the request of the captain or RLL staff.
- HAND LUGGAGE AND OTHER CARRIED ITEMS
- A passenger may carry easily portable items as hand luggage on the Vessels free of charge and store them in designated places. It is forbidden to carry on the Vessels:
- items with an individual weight exceeding 20 kg;
- dangerous substances and items which, according to the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN), are prohibited for international carriage on vessels or are permitted only under certain conditions;
- weapons, with the exception of weapons held by members of security forces and the armed forces;
- items whose carriage is prohibited by legal regulations;
- items that interfere with the operation of the Vessel or cause damage.
- The passenger is solely responsible for items brought onto the Vessels and is also liable for any damage caused by such items. JPP is not responsible for damage to luggage and other items brought onto the Vessels, consisting especially, but not exclusively, in the loss of luggage or other items, their falling into the water, etc.
- If space is available on the Vessel, wheelchairs and strollers may be carried. The decision on the possibility of carriage in the case according to the previous sentence is made by JPP staff.
- Bicycles, kits, and other sports equipment are carried according to available space based on an individual agreement for a fee specified in the fare price list.
- Bicycles and electric bicycles cannot always be carried on every vessel operated by RLL. They can usually be carried on the Green and Pink lines.
- Electric bicycles must not be recharged on the boat. The user is obliged to keep electric bicycles and electric scooters under supervision and, if possible, remove the battery.
- In case of doubt, JPP staff shall decide on the carriage of luggage and other items.
- A passenger may carry easily portable items as hand luggage on the Vessels free of charge and store them in designated places. It is forbidden to carry on the Vessels:
- LIVE ANIMALS
- Dogs of all breeds and sizes must be on a short leash and muzzled or in closed containers (dog transport box or a firmly closed bag for transporting dogs).
- All other animals may be admitted for carriage only if they are placed in closed containers (transport boxes) and there is no risk that they would endanger or harass other passengers. Such carriage requires the consent of the Vessel’s captain.
- RECORDING
- By purchasing a ticket and entering the Vessel (i.e., by concluding a contract of carriage), the passenger expressly agrees and gives permission for JPP, within the meaning of the provisions of Section 84 et seq. of Act No. 89/2012 Coll., Civil Code, as amended, to take photos, audio recordings, and video recordings of passengers during carriage and related events and to publish them on JPP’s website and social networks and in printed materials. The passenger cannot derive any legal claims from these recordings.
- PERSONAL DATA PROTECTION
- JPP processes personal data exclusively in accordance with the provisions of Act No. 110/2019 Coll., on the processing of personal data, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR Regulation). Detailed information on the processing of passengers’ personal data is published on JPP’s website.
- JURISDICTION
- These Conditions are issued in the Czech language. In the event that these Conditions are also issued in another language, then in the case of any difference between the wording of these Conditions in the Czech language and the wording of the Conditions in another language, the version of these Conditions in the Czech language shall prevail.
- By purchasing a ticket and entering the Vessel (i.e., by concluding a contract of carriage), the passenger expressly agrees that the rights and obligations of JPP and the passengers arising from the contract of carriage and/or these Conditions or in connection with the contract of carriage and/or these Conditions, or other rights and obligations arising from these Conditions, are governed by the applicable law of the Czech Republic. In the event of a dispute with an international element, the contracting parties agree on the law of the Czech Republic as the governing law for disputes arising from the contract of carriage and/or these Conditions, in connection with the contract of carriage and/or these Conditions, as well as tort claims, i.e., claims for compensation for damage (harm), or unjust enrichment arising from the contract of carriage and/or these Conditions or in connection with the contract of carriage and/or these Conditions, which arise between JPP and the passenger (hereinafter referred to as “Disputes”), whereby neither a renvoi nor a further reference shall apply. By purchasing a ticket and entering the Vessel (i.e., by concluding a contract of carriage), the passenger expressly agrees that the exclusive jurisdiction of the courts of the Czech Republic is agreed for the resolution of all Disputes, whereby the subject-matter and territorial jurisdiction of the court is governed by the general court of JPP.

- SCOPE AND PURPOSE OF PERSONAL DATA PROCESSING
- We process the following data: first name, surname, postal address, email address, and telephone contact. We process the data for the following purposes:
- Performance of contract and pre-contractual negotiations: Necessary for processing orders, selling services in the e-shop, and communicating with the customer.
- Legal obligations: Bookkeeping and fulfillment of tax obligations.
- Legitimate interest: Direct marketing (sending commercial communications to existing customers), fraud prevention, and diagnostics of technical problems of the website.
- Voluntary consent: Participation in bonus programs, marketing competitions, and customized advertising (social networks).
- COOKIES AND WEB BEACONS
- Cookies: Used to facilitate navigation and remember preferences. We use:
- Functional cookies: Necessary for the operation of the website and security (always on).
- Marketing/Social cookies: Allow connection with social networks and ad targeting. These are active only with your consent granted in the cookie bar.
- Web beacons: Electronic images in emails used to track message opening for the purpose of improving communication.
- You can manage cookies directly in your internet browser settings.
- Cookies: Used to facilitate navigation and remember preferences. We use:
- RECORDING OF TELEPHONE CALLS
- The controller may record calls on the customer line for the purpose of concluding contracts, handling complaints, and increasing the quality of services.
- Consent to recording is granted by continuing the call after the operator’s notification. If you do not wish to be recorded, please hang up and use email communication.
- STORAGE PERIOD AND DATA RECIPIENTS
- We process personal data for the period necessary to fulfill the contract and the limitation periods (usually 3–5 years), and for 10 years for tax documents. For marketing purposes, data is stored for 7 years or until consent is withdrawn.
- Data may be transferred to verified third parties: carriers, payment and IT service providers, accounting advisors, and, in necessary cases, state administration authorities.
- YOUR RIGHTS AS A DATA SUBJECT
- In accordance with the Regulation, you have the right:
- to access your data and information about its processing;
- to correct inaccurate data;
- to erasure (right to be forgotten) if the purpose of processing has passed;
- to restriction of processing and to data portability;
- to object to processing for marketing purposes;
- to withdraw consent to processing at any time;
- to file a complaint with the Office for Personal Data Protection (www.uoou.cz).
- In accordance with the Regulation, you have the right:
- DATA SECURITY
- The controller implements all technical and organizational measures to protect data. User accounts are protected by encrypted passwords.
- The controller is not responsible for the misuse of data that occurred as a result of unauthorized access by a third party caused by the user’s negligence (e.g., disclosure of password).
